SECTION27 recently made a written submission to Parliament on the State Liability Amendment Bill [B 2--2001]. In short, SECTION27 supports how the Bill seeks to regulate the manner in which a final court order sounding in money against the state must be satisfied – it sees the Bill as being squarely in line with the decisions of the Constitutional Court in Nyathi v MEC for Department of Health, Gauteng and Another [2008] ZACC 8 (“Nyathi 1”) and Minister for Justice and Constitutional Development v Nyathi [2009] ZACC 29 (“Nyathi 2”) dealing with the unconstitutionality of section 3 of the State Liability Act 20 of 1957 and how it is to be remedied.

Insurance products for people living with HIV

Many people living with HIV continue to face unfair discrimination in various aspects of their lives. SECTION27 often receives reports from people who are denied access to insurance products solely on the basis that they are HIV positive, or are offered cover at what appear to be highly inflated prices. SECTION27 recently met with representatives of the Association for Savings and Investment South Africa (ASISA) to raise concerns we have regarding the current approaches and practices of the insurance industry in relation to HIV.

Millions call for freedom for Chinese HIV/AIDS activist Tian Xi

Yesterday, March 1st 2011, a memorandum was sent to the highest officials in the UN, UNAIDS, WHO and the Chinese government. It is signed by more than 120 organisations, from across the world, including many within China. It is signed by prominent individuals, human rights organisations and trade unions, including the powerful two million member COSATU.

SECTION27 and the Treatment Action Campaign welcome the increased budget for health

SECTION27 and the TAC welcome the proposed increases in health expenditure outlined in the budget tabled by Minister of Finance Pravin Gordhan on 23 February 2011. In particular, we welcome the Minister’s commitment to significant investment in strengthening the public health sector. However, we are concerned that the additional R11 billion available for 2011/12 will not necessarily translate into improvements in the delivery of health care services in the absence of a reasonable plan to address endemic and systemic problems with budgeting and expenditure within health departments at all spheres of government.

Tian Xi is a courageous advocate for the thousands of people infected with HIV through China’s blood disaster, who now demand government accountability. We call for Tian Xi’s immediate release and for a national compensation plan for the thousands of victims of the blood disaster.

Judgment reaffirms rights of people with HIV to non-discrimination in employment

SECTION27 welcomes the judgment handed down by Judge Bhoola today in the Labour Court in the case of Gary Shane Allpass v Mooikloof Estates (Pty) Ltd. The case concerns the unfair dismissal in 2008 of a horse riding instructor on the grounds of his HIV status. The ruling follows the institution of legal proceedings on behalf of Mr Allpass by Webber Wentzel Attorneys, with the assistance of SECTION27. In her judgment, Judge Bhoola noted that “this court is indebted to the AIDS Law Project for its assistance.” SECTION27 incorporates the AIDS Law Project.

Judgment to be handed down by Labour Court in important HIV related unfair discrimination matter

On Wednesday, 16 February 2011 at 10.00am Justice Bhoola will deliver judgment in the Mooikloof Estates matter at the Labour Court in Braamfontein. The case was heard in the Labour Court in December 2010. It relates to the unfair dismissal of a horse-riding instructor and stable manager by Mooikloof Estates in Pretoria. Mr Allpass was dismissed immediately after his former employer discovered that he was HIV positive.

We support implementation of a programme of HIV Counselling and Testing (HCT) for Teens … but proper planning and protection of human rights of learners is essential. The Treatment Action Campaign (TAC), The Yezingane Network (YN) , Equal Education and SECTION27 welcome the Department of Health’s plans to extend HIV Counselling and Testing (HCT) campaign to children 12 years and older.
